CONSTITUTIONAL COURT JUDGMENT: SECTIONS 24 & 28 OF FCA 

Dear Member,

This is a quick notice with information on the outcome of the Constitutional Court's decision reported on in our Newsletter Vol. 13(24) regarding sections 24 & 28 of the Firearms Control Act (Act 60 of 2000 - FCA).  We shall soonest provide advice on what we suggest members who are caught "on the wrong side" of the judgment, could do.

The Constitutional Court found that the provisions of sections 24 and 28 of the FCA, which govern the renewal and expiry of firearm licenses are NOT UNCONSTITUTIONAL.

In Short:

  • The Constitution of sections 24 and 28 of the FCA still remains the same
  • Immediately check ALL your Firearm licenses for their Expiry date (You need to renew 90 days before the expiry date of such a firearm license)
  • Firearm Amnesty could or could not be declared, the particulars will be sent out once we have confirmation thereof
  • NOTE: This is for those members who have expired WHITE CARD firearm licenses in their possession. GREEN LICENSES are still valid
